Acceptance of Terms
By accessing the Earthworm Construction website, requesting an estimate, or hiring Earthworm Construction for services, you agree to these Terms & Conditions. If you do not agree with these terms, please do not use this website or request our services.
Our Services
Earthworm Construction provides residential and commercial asphalt paving, resurfacing, asphalt repair, chip seal, sealcoating, parking lot services, access-road improvements, and snow-removal services throughout North Central Ohio.
The exact scope of each project will be described in the customer’s written estimate, proposal, or service agreement.
Estimates & Quotes
Estimates are based on the information and site conditions available at the time of inspection. Final pricing may change if additional damage, unsuitable base materials, drainage problems, underground obstructions, access limitations, or other unforeseen conditions are discovered.
Any significant changes to the project scope or price will be communicated before additional work is completed.
Scheduling & Site Access
Project dates are subject to weather, material availability, equipment availability, and site readiness.
Customers are responsible for:
Providing safe and reasonable access to the work area.
Moving vehicles, trailers, equipment, and other obstacles before work begins.
Informing Earthworm Construction of underground utilities, private lines, irrigation systems, or other hidden conditions.
Following all instructions regarding when newly completed surfaces may be driven or walked on.
Earthworm Construction may postpone or reschedule work when conditions could affect safety or workmanship.
Customer Responsibilities
The customer is responsible for obtaining any permits, approvals, or permissions required for the project unless the written agreement specifically states that Earthworm Construction will handle them.
Earthworm Construction is not responsible for damage to unmarked private utilities, underground wiring, drainage systems, irrigation lines, or other hidden objects that were not disclosed before work began.
Payment Terms
Payment terms will be listed in the customer’s written estimate or agreement. Deposits may be required before scheduling or ordering materials.
Unless otherwise stated in writing, the remaining balance is due when the agreed-upon work is completed.
Additional services, materials, or project changes requested by the customer may result in additional charges.
Surface Appearance & Maintenance
Asphalt, chip seal, sealcoating, and related surfaces may naturally vary in color, texture, stone distribution, and appearance. Minor surface variations do not necessarily indicate defective workmanship.
Customers are responsible for routine maintenance, including cleaning, crack filling, drainage maintenance, and sealcoating when appropriate.
Warranties
Earthworm Construction stands behind its workmanship. Any specific warranty will be described in the customer’s written proposal or service agreement.
Warranties do not cover damage caused by:
Normal wear and tear.
Severe weather or freeze-and-thaw conditions.
Improper drainage or standing water.
Heavy vehicles or loads beyond the surface’s intended use.
Fuel, oil, chemicals, snowplows, sharp objects, or customer misuse.
Movement or failure of the underlying ground or base.
Work performed or altered by another contractor.
Snow-Removal Services
Snow-removal and ice-management services are performed according to the customer’s written service agreement.
Earthworm Construction cannot guarantee completely dry, ice-free, or slip-free conditions. Weather may change rapidly, and snow or ice may continue to accumulate after service has been completed.
Customers and visitors remain responsible for using reasonable caution during winter conditions.
Cancellations & Delays
Customers should provide notice as soon as possible when requesting a cancellation or schedule change.
Earthworm Construction is not responsible for delays caused by weather, material shortages, equipment failure, labor availability, site conditions, emergencies, or circumstances outside its reasonable control.
Deposits may be nonrefundable when materials have been ordered, labor has been scheduled, or other project expenses have already been incurred.
Limitation of Liability
To the fullest extent permitted by law, Earthworm Construction will not be responsible for indirect, incidental, special, or consequential damages related to the use of this website or the performance of services.
Earthworm Construction’s total liability for any claim related to a project will not exceed the amount paid for the specific services involved in that claim.
Website Content & Intellectual Property
All website content, including text, photographs, videos, logos, designs, and graphics, belongs to Earthworm Construction or is used with permission.
Website content may not be copied, reproduced, distributed, or used commercially without prior written permission.
Governing Law
These Terms & Conditions are governed by the laws of the State of Ohio. Any dispute relating to these terms or services provided by Earthworm Construction will be handled in the appropriate state or local court located in Ohio, unless otherwise agreed in writing.
Changes to These Terms
Earthworm Construction may update these Terms & Conditions periodically. Changes will be posted on this page along with an updated revision date.
Continued use of the website or services after changes are posted means that you accept the revised terms.
